Terms of Use

These terms govern access to AltScrap, including AltScrap websites, tenant portals, customer pre-registration, supplier onboarding, staff tools, reports, integrations, and related services.

1. Agreement To These Terms

AltScrap is owned and operated by Mighty Projects Pty Ltd (ABN 44 654 198 553). References to "AltScrap", "we", "us", or "our" mean Mighty Projects Pty Ltd trading as or providing the AltScrap platform, unless the context requires otherwise.

By accessing or using the service, creating an account, submitting a form, signing an agreement, processing a transaction, or using a tenant portal, you agree to these Terms of Use and the Privacy Policy. If you do not agree, you must not use the service.

If you use the service for a company, yard, supplier, partnership, trust, or other organisation, you confirm that you are authorised to accept these terms for that organisation and that organisation is responsible for your use of the service.

2. Platform Role And Yard Operator Role

Mighty Projects Pty Ltd provides AltScrap software used by recycling and scrap-metal businesses to operate staff tools, customer portals, supplier onboarding, pricing displays, reports, receipts, and integrations.

Where a company-branded portal is used, the participating yard operator is responsible for its yard operations, material acceptance, identity checks, supplier approvals, prices, GST/RCTI treatment, payment decisions, receipts, store information, safety requirements, and customer or supplier relationships.

Unless expressly stated otherwise, AltScrap is not a buyer or seller of scrap materials, is not a party to transactions between yards and customers or suppliers, and does not set final purchase prices or decide whether materials will be accepted.

3. Accounts, Staff Access, And Security

You must provide accurate, current, and complete information and keep it updated. This includes contact details, ABN, GST status, store information, bank or PayID details, identity information, supplier details, pricing data, and transaction records.

Staff users are responsible for keeping login credentials secure, using only their own account, and ensuring account permissions match their role. Company administrators are responsible for inviting, removing, and supervising staff users.

You must notify us or the relevant yard operator promptly if you suspect unauthorised access, incorrect account details, compromised credentials, mistaken payments, or inaccurate transaction records.

4. Customer And Supplier Portals

Customer pre-registration and supplier pre-registration do not guarantee approval, purchases, pricing, payment, credit, account creation, or access to a yard. A yard operator may require photo identification, business verification, bank verification, safety acknowledgements, tax information, RCTI agreement steps, or other checks before accepting materials or making payments.

Material lists, indicative prices, opening hours, store locations, contact details, and other portal information may change without notice. Final acceptance, classification, grading, contamination assessment, weight, deductions, and payment amount are determined by the yard operator at the time of transaction.

5. Payments, GST, RCTI, And Tax

AltScrap may help generate records, receipts, recipient-created tax invoice materials, reports, payment files, or integration data. These tools do not replace accounting, tax, legal, or financial advice.

Yard operators and suppliers are responsible for confirming ABN, GST registration status, entitlement to issue or receive RCTIs, bank or PayID details, tax treatment, and compliance with applicable laws and ATO requirements. You must not submit false GST, ABN, banking, or supplier information.

Payment timing depends on the yard operator, payment provider, bank, integration provider, verification checks, and other circumstances outside AltScrap's control. AltScrap is not responsible for delays, reversals, rejections, chargebacks, bank errors, or incorrect payment details supplied by a user or yard operator, except to the extent required by law.

6. Integrations And Third-Party Services

The service may connect to third-party systems such as payment providers, accounting platforms, email services, mapping services, fraud prevention tools, identity or business verification services, cloud hosting, and analytics providers.

Third-party services are governed by their own terms and privacy policies. We do not control their systems and are not responsible for their acts, omissions, outages, data handling, pricing, feature changes, or API changes. We may suspend or modify integrations where necessary for security, reliability, compliance, or operational reasons.

7. Acceptable Use

You must not, and must not permit anyone else to:

  • submit false, misleading, fraudulent, unlawful, or unauthorised information;
  • access accounts, portals, data, systems, or integrations without permission;
  • interfere with, overload, scan, scrape, reverse engineer, or disrupt the service;
  • upload malicious code or attempt to bypass authentication, rate limits, or security controls;
  • use the service to facilitate theft, unlawful trading, tax evasion, money laundering, or fraud;
  • misrepresent prices, weights, payments, identity, GST status, bank details, or transaction records;
  • infringe intellectual property, confidentiality, privacy, or other third-party rights.

8. Data, Records, And Audit Trails

The service may create audit logs, system records, transaction records, receipt records, staff activity records, authentication events, and integration logs. These records may be used to operate the service, support security, investigate errors or disputes, comply with law, and maintain business records.

You are responsible for checking exported data, reports, receipts, RCTI materials, and integration outputs before relying on them. We may correct, restore, or remove data where reasonably necessary to address errors, security issues, duplicate records, suspected fraud, or legal requirements.

9. Intellectual Property And Feedback

The AltScrap platform, software, interface, designs, workflows, documentation, branding, and related materials are owned by Mighty Projects Pty Ltd or its licensors. You receive a limited, revocable, non-transferable right to use the service for its intended purpose.

You retain ownership of information you submit. You grant us the rights needed to host, process, transmit, display, back up, analyse, and use that information to provide, secure, support, and improve the service. If you provide suggestions or feedback, we may use them without restriction or compensation.

10. Availability, Changes, And Beta Features

We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free, or permanent access. The service may be affected by maintenance, outages, third-party providers, internet issues, device problems, security incidents, or events outside our reasonable control.

We may add, remove, suspend, or change features, including beta or trial features, where reasonably necessary. Beta, trial, or preview features may be incomplete, may change quickly, and may be withdrawn.

11. Confidentiality

Staff users and yard operators may access sensitive business, customer, supplier, pricing, and transaction information. You must use that information only for authorised business purposes and must not disclose it except where authorised, required for operations, or required by law.

12. Consumer Law And Liability

Nothing in these terms excludes, restricts, or modifies any guarantee, right, remedy, or liability that cannot be excluded under the Australian Consumer Law or other applicable laws.

To the maximum extent permitted by law, we exclude liability for indirect, consequential, special, exemplary, loss-of-profit, loss-of-revenue, loss-of-goodwill, loss-of-data, or business interruption losses arising from or connected with the service.

To the maximum extent permitted by law, our total liability for claims arising from or connected with the service is limited to resupplying the service, paying the cost of resupply, or the amount paid to us for the affected service in the previous 12 months, whichever is greater. This limitation does not apply where the law does not allow it.

13. Indemnity

You indemnify us against losses, claims, costs, expenses, and liabilities arising from your breach of these terms, your misuse of the service, information you submit, unlawful or fraudulent activity, or transactions and disputes between yard operators, customers, suppliers, staff, or third parties, except to the extent caused by our fraud, wilful misconduct, or breach of law.

14. Suspension And Termination

We may suspend or terminate access, block transactions, disable accounts, remove content, or restrict features if we reasonably believe there is a security risk, legal risk, suspected fraud, unauthorised access, breach of these terms, unpaid amount, request from a yard operator, or operational need.

Suspension or termination does not affect rights and obligations intended to survive, including confidentiality, intellectual property, liability limits, indemnities, payment obligations, record retention, and dispute provisions.

15. Changes To These Terms

We may update these terms from time to time. The updated version will be posted on this page. Continued use of the service after an update means you accept the updated terms. Where changes are material, we will take reasonable steps to notify affected users.

16. Governing Law And Contact

These terms are governed by the laws of Victoria, Australia. The courts of Victoria and the Federal Court of Australia have non-exclusive jurisdiction. Contact us at support@altscrap.com with questions about these terms.
